By using the website, making a booking or contracting a FAMA BUGGY service, the client declares to have read and accepted these Terms and Conditions, without prejudice to the rights conferred by applicable legislation.

3. Use of the website
The user undertakes to use the website lawfully and appropriately.
It is prohibited to:
- Use the website for fraudulent purposes;
- Introduce false or misleading information;
- Attempt to obtain unauthorized access to the systems;

- Make fraudulent bookings or bookings without intention to use them.

Where the booking is made through the website, the client shall provide correct and complete information.
The booking shall only be considered confirmed after verification of the applicable conditions and, where required, after payment of the amount or deposit indicated in the booking process.
After confirmation, the client shall receive a receipt containing the relevant booking information.
6. Prices
The prices presented on the website correspond to the amounts applicable to the selected service.
Where legally required, prices presented to the consumer shall include applicable taxes.
Before the booking is concluded, the client shall be informed of the total applicable price.
Different prices may apply depending on:

FAMA BUGGY reserves the right to change future prices, without affecting already confirmed bookings, except in legally provided situations.
7. Payments

A booking subject to payment shall only be considered paid when the payment has been effectively confirmed.
In the event of payment failure, the booking may not be confirmed or may be cancelled in accordance with the conditions presented to the client.

Before the booking is concluded, the client shall be informed of the applicable conditions.
Where a specific policy exists for a given tour or rental, that policy shall prevail over the general conditions, to the extent legally permissible.

10. Requirements for participation

- Driving licence;
- Driving experience;
- Number of participants;
- Equipment;
- Physical condition;
- Documentation;
- Other safety requirements.
The client is responsible for verifying that they meet the requirements presented for the activity before making the booking.
FAMA BUGGY may refuse the participation of a person who does not meet the applicable safety requirements.
11. Driving licence and documentation
Where driving a buggy requires a driving licence or other document, the client shall present valid documentation when requested.
The right to drive the vehicle may be refused if the client does not present the required documentation or does not meet the legal requirements.
12. Safety rules
During activities, the client shall comply with:
- Instructions from guides and staff;
- Applicable traffic rules;
- Specific route rules;
- Instructions regarding vehicle use;
- Rules regarding safety equipment.
Driving under the influence of alcohol, drugs or other substances that may compromise driving ability or safety is prohibited.
FAMA BUGGY may interrupt the participation of any person whose conduct represents a risk to themselves, to third parties, to the vehicle or to the environment.
13. Use of vehicles
Vehicles shall be used in accordance with the instructions provided by FAMA BUGGY.
It is prohibited to use the vehicle:
- Negligently;
- In conditions incompatible with its use;
- For unlawful purposes;
- In prohibited areas;
- Under the influence of alcohol or drugs;
- In a manner likely to cause unnecessary damage;
- To transport persons under unauthorized conditions.
The client shall immediately report any accident, breakdown or damage.
14. Damages and client liability
The client may be liable for damages caused to the vehicle where these result from negligent, reckless, intentional use or in breach of the conditions of use, without prejudice to the limitations and rights provided by law.
The specific conditions regarding deposits, deductibles, insurance and liability shall be presented before the rental is contracted.

15. Deposit
Where applicable, a deposit may be required before the vehicle is delivered.
The deposit shall be used in accordance with the conditions previously communicated to the client.
Where there is no damage, charges or legitimately owed amounts, the deposit shall be returned under the terms and timeframe communicated by FAMA BUGGY.
16. Insurance
The insurance conditions applicable to each service shall be presented before contracting.

The client shall verify the coverages, exclusions, deductibles and other applicable conditions before using the vehicle.
17. Punctuality
The client shall arrive at the location and time indicated in the booking confirmation.
Late arrival may reduce the time available for the activity, without prejudice to the specific conditions of each service.
In the event of significant delay, FAMA BUGGY may consider the booking as a no-show, where this is provided for in the specific conditions communicated to the client.
18. Capacity and participants
Each vehicle has a maximum capacity.
The maximum number of occupants indicated for each vehicle shall be respected.
Using the vehicle with a number of occupants above the authorized limit is not permitted.
19. Cancellation by FAMA BUGGY
FAMA BUGGY may cancel or change an activity where necessary for safety reasons, weather conditions, unexpected vehicle unavailability, force majeure or other circumstances that reasonably prevent the activity from taking place.
In such situations, the refund, rescheduling or alternative solution conditions communicated to the client shall apply, without prejudice to legally applicable rights.
20. Right of withdrawal and legal exceptions
Where applicable, distance contracts are subject to legal rules regarding the right of withdrawal.
However, there are legal exceptions and specific rules applicable to certain services related to leisure activities where the contract provides for a specific date or period of execution.
The specific applicable conditions shall be determined in accordance with the legislation in force and the nature of the contracted service.
21. Liability
FAMA BUGGY undertakes to provide the contracted services with diligence and in accordance with the information provided to the client.

- Brand;
- Texts;
- Photographs;
- Videos;
- Graphics;
- Design;
- Visual elements;
- Code and structure,
is the property of FAMA BUGGY or legitimately used through licence or authorization.
